1. Acceptance of Terms
By accessing or using the PhotoZum platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
PhotoZum provides an AI-powered real estate photo enhancement platform designed to optimize property images for listings. The Service includes features such as automated lighting correction, HDR enhancement, sky replacement, and object cleanup. The Service is provided on a credit-based system, where users purchase credits or subscribe to plans to process images.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.
4. Credits and Payments
Credit System: The Service operates on a credit system. Credits are required to process and download enhanced images. Credits can be purchased as one-time packs or via a monthly subscription.
Subscription Plans: We offer Free, Pro, and Agency subscription plans. Subscription fees are billed in advance on a monthly basis. Unused credits from a monthly subscription do not roll over to the next month unless explicitly stated in your plan details.
Payments: All payments are processed securely through Stripe. We do not store your credit card information on our servers.
Refund Policy: Credits are non-refundable once used to process an image. Subscription fees are non-refundable except as required by law. If you cancel your subscription, you will retain access to your remaining credits until the end of your current billing period.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- To upload any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- To mislead or deceive others regarding the physical condition of a property in a way that violates real estate advertising laws or regulations.
- To reverse engineer, decompile, or disassemble any aspect of the Service.
- To attempt to gain unauthorized access to the Service, user accounts, or computer systems or networks connected to the Service.
6. Intellectual Property
User Content: You retain all rights and ownership of the photos you upload to the Service. We do not claim ownership over your original or enhanced images.
Platform Rights: The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of PhotoZum and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
7. User Content License
By uploading photos to the Service, you grant PhotoZum a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of providing and improving the Service (e.g., processing your images).
We may store your original and enhanced images for a limited time to allow you to download them. You can delete your images from your library at any time, which will permanently remove them from our servers.
8. AI-Generated Content Disclaimer
The enhancements provided by the Service are generated by Artificial Intelligence (AI). While we strive for high quality and realism, results may vary depending on the quality of the original image and the specific scene.
PhotoZum does not guarantee that the enhanced images will comply with specific listing requirements of third-party platforms (e.g., MLS, Airbnb, Zillow), although we provide presets designed to meet common standards. You are solely responsible for reviewing the final images to ensure they accurately represent the property and comply with all applicable laws and regulations.
9. Limitation of Liability
In no event shall PhotoZum, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account from your profile settings.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
